Who needs a form 8a?

Is it accompanied by other forms?
You should send one copy to your spouse and attach an Affidavit of Service to the copy you file in court.
When is form 8a due?
There is no due date for this application. If you have to respond to it, you have 30 days.
How do I fill out form 8a?
There is an English and a French version of this application. Choose which is more convenient for you to complete and remove the extra sheets from the application. On the first page, give the names and addresses of the applicant and respondent and add the names and contacts of their lawyers. Describe what you request (financial support, exclusive possession of the matrimonial home) on the second page. Page 3 includes the questionnaire about family history (applicant’s and respondent’s surnames, previous divorces if any, the age of children and who takes care of them, important relationship dates). On page 4, you will find a table where you should check what you are claiming for: a simple divorce, custody of children, restraining order etc. Also write about reasons that support your claim for divorce, like separation, adultery or cruelty. Your lawyer has to fill out the lawyer’s certificate on page 5.
Where do I send it?
Submit it to the court clerk. He will open the case and sign the notice of motion if needed.
